Please find below specific Terms & Conditions relating to the Thorndale and additional Terms & Conditions relating to your reservation and stay.

DEFINITIONS

When the following words are used in this Terms and Conditions document, this is what they mean:

Booking: Your request to occupy the Property for the Rental Period as made via the Larque Property Website, phone or by any other means.

Booking Confirmation: the written confirmation sent by us to you confirming the agreement for you to occupy the property during the rental period.

“We/Us/Our” means Larque Property. 

Property: the property as defined within the Booking Confirmation.

Rental Period: the period of time for which Larque Property shall make available the Property to the Guest as set out in the Booking Confirmation.

Shadow Security Deposit: the security deposit ‘shadow payment’ to be authorised by you in accordance with clause 2.

Terms/Conditions: The Terms and Conditions set out in this document, the Property Specific Terms and any other Terms referred to in these Terms and/or provided to you by us.

Property Specific Terms: specific restrictions applicable to the Property as provided to the Guest by us. (including those set out on Our Website).

You/Your/Guest/s: the Guest and or his/her invitee to the Property. The Lead Guest is the lead person on the Booking Confirmation.

1. BOOKING CONDITIONS

1.1 By submitting a Booking, you confirm that You have fully read, understood, and agreed to the Terms and Conditions.

1.1.1 Please note that the minimum booking requirement for the property is 3 nights. However, during peak season, which may vary depending on the property, the minimum booking requirement increases to 5 nights. We kindly ask that you keep this in mind when making your reservation.

1.2 You must be at least 18 years old when you make your booking. By making a booking you confirm that you are at least 18 years old.

1.3 The number of persons occupying the property must not exceed the maximum number stipulated in the property specific terms. We reserve the right to refuse entry to all guests (or to require guests to vacate the Property) if this condition is not adhered to.

1.4 All Guests agree to arrive and leave the property at the dates and times set out in the Booking Confirmation (unless any other arrangements are agreed with us in advance). The property will not be available at any times outside of the times reserved by you. We reserve the right to make a reasonable additional charge through deduction of your Security Deposit in the event that you have not left the Property at the agreed departure time.

1.5 This Booking agreement is made on the basis that the Property is to be occupied by the guests as a holiday letting within the meaning of the Housing Act 1988 Schedule 1 Paragraph 9. The guests acknowledge that the licence granted by the rental agreement entered into with Larque Property is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.

1.6 The Lead Guest will assume responsibility for all guests' compliance with the Terms and Conditions.

1.7 Your right to occupy the Property may be forfeited and you may be required to vacate the Property without compensation if:

 1.7.1 More people declared at the time of Booking attempt to occupy the property.

  1.7.2 Pets are brought into the property.

 1.7.3 Any activity is undertaken which is illegal, or which causes may cause unreasonable noise, nuisance, damage or disturbance.

1.8 You shall keep the Property and all furniture, fixtures, fittings and effects in or on the Property in the same state of repair as at the commencement of the rental period and shall leave the property in the same general order in which it was found.

1.9 You confirm that the information you have provided to Larque Property is true, accurate, current and complete information in all respects. Should any information provided change you should notify Larque Property immediately bookings@larqueproperty.co.uk. We shall not be liable if any incorrect information provided by you results in us being unable to perform (or entitled to terminate) the rental agreement.

1.10 Due to the high-end nature of this property, for safety and security reasons, we require an uploaded proof of ID either a driving license or passport photo from the lead guest at time of booking the Thorndale. Please refer to our Privacy Policy .

2. THE SECURITY DEPOSIT - DAMAGE, BREAKAGE & MISSING ITEMS

2.1 A security deposit will be required by you in respect of damage to the property, damage or loss of contents, or incorrect use of facilities, or other breach by you of these terms.

2.2 A member of our team will email you with a payment link 1-2 days prior to your booking date, to take a pre-authorised transaction ‘shadow payment’ from your credit card for the sum of £250 as a security deposit. This amount will not be taken from your account unless there have been damages/breakages in Thorndale. Unfortunately, we will not be able to provide the property access code to guests without a valid pre-authorisation on a credit/debit card. If the pre-authorisation shadow payment for the security deposit is not completed prior to your check-in date, your booking will be null and void and monies paid for the booking will be non-refundable. 

2.3 We are entitled to deduct from the Security Deposit in the following circumstances:

• 2.3.1 Should you or your accompanying guest damage the property, or any equipment or fittings at the property.

• 2.3.2 Should you or your accompanying guest be in breach of any of the Terms and Conditions.

• 2.3.3 Should we be required to remedy any damage caused to the property during your stay.

2.4 The Guest must report any damage immediately to us: bookings@larqueproperty.co.uk

2.5 If no deductions are required, the ‘shadow payment’ shall be removed within 2-3 business days after your stay.

2.6 Should a claim be made by us against the security deposit, details of such a claim will be provided to you within 7 days of the end of your rental period (or after such longer period as may be required for the deductions to be calculated).

2.7 Should the security deposit provide insufficient remedy; we have the right to recover any sum from you to make up any shortfall.

2.8 In the event that you or your accompanying guest causes severe damage to the property which results in us having to cancel subsequent bookings due to the property being left in an uninhabitable state by you, or which reduces the services offered to subsequent guests, you shall indemnify us in full for any loss incurred which the Security Deposit does not cover.

3. METHODS OF PAYMENT

3.1 Bank Transfer (BACS). The booking is provisional until payment arrives in our bank account, and a reservation payment email has been despatched. We will hold the booking for you pending the BACS transfer for 2 hours, after this time if payment has not been received, we have the right to make these dates available on the website calendar. Bank details can be found at the bottom of the booking confirmation email which you will receive within minutes of completing the online booking process.

3.2 Credit card. Payment is made immediately via Stripe, as soon as we receive notification that your payment has been made, a reservation payment email will be despatched.

3.3 Details of all methods of payment can be found on the payment page on the online booking system.

4. CANCELLATIONS

4.1 The following Cancellation Policy for bookings made, including package is as stated below:

• 4.1.1 Full refund for cancellations made within 48 hours of booking if the check-in date is at least 14 days away.

• 4.1.2 50% refund for cancellations made at least 7 days before check-in.

• 4.1.3 No refunds for cancellations made within 7 days of check-in.

4.2 Once Thorndale is booked the guest has entered a legally binding contract. If the Guest cancels, for whatever reason (including medical and weather related) the above cancellation policy will prevail regardless.

4.3 We recommend you take out cancellation insurance that covers pre booked UK self-catering holidays due to adverse weather, ill-health, bereavement etc. as the above refund terms are non-negotiable.

4.4 Your booking may not be moved from one date to another once made except at the discretion of the team. If you wish to change the booking date you will have to cancel the original booking and the normal cancellation policy will prevail regardless of any subsequent booking made.

4.5 In an event of the accommodation becoming unavailable we have the right to cancel your booking in advance. We would only cancel your booking if your accommodation was unavailable to be let for reasons/events outside our control. Event outside of our control means any act or event beyond our reasonable control including without limitation, actions or omissions of us (including, but not limited to, cancellation or failure to provide access to the Property) strikes, lockouts or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war, (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks, power networks or water supplies, local building works or roadworks, transport interruptions, delays or cancellations. We would refund all monies paid by you for Thorndale. Our liability would not extend beyond this refund.

5. SELF-CHECK-IN & CHECK-OUT

5.1 The self-check-in time for Thorndale is any time after 4pm. Check-out time is at 11am on the day of departure.

5.2 The period before and after your stay is likely booked by other guests, so please respect the stated check-in and departure times so that we have enough time to prepare for the next guests (the result of your late departure could incur charges against your Security Deposit as a result of housekeeping staff being prevented from accessing the property at the agreed departure time).

6. EARLY CHECK-IN/LATE CHECK-OUT

6.1 There is an option to book an earlier check-in time at 1pm or a later check-out time at 1pm. This is at an additional rate of £70 each end. Available to add at check-out. 

7. GUEST OCCUPANCY

7.1 A maximum of 10 people are ONLY permitted to occupy Thorndale. We ask that Thorndale is only occupied by the guests associated with the booking. We reserve the right to require guests to vacate the Property if this condition is not adhered to. The guest will remain liable for the whole cost of the booking and no refund shall be due.

8. PETS

8.1 Due to the level of finish offered in this house the decision has been made NOT to allow any pets. We reserve the right to require guests to vacate the Property if this condition is not adhered to. The guest will remain liable for the whole cost of the booking and no refund shall be due.

9. NOISE AND/OR NUISANCE

9.1 Your enjoyment during your stay is important to us, however we kindly ask you to be mindful that this house is in a residential/family area, please respect our neighbours regarding level of noise.

9.2 Disruptive parties and events and open-invitation gatherings are not allowed.

9.3 If, in the opinion of the team, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to neighbours, the contract may be treated by the team as discharged and the team may repossess the property immediately. The guest will remain liable for the whole cost of the booking and no refund shall be due.

10. AMENITIES

10.1 Thorndale has amenities such as a hot tub, Cinema, Gym & Games Room.

10.2 We do not accept liability for any accident or mishap to persons or property while on the premises. All amenities should be used with great care and in accordance with the property information pack (Airguide), and all rules, user manuals and signage. Children are required to be supervised at all times by a responsible adult.

11. PARKING

11.1 There is ample parking on the Thorndale's private drive for up to five vehicles, secured by elecric gates. Additionally, there is also space to park further vehicles on the road outside the property if required pending space.

11.2 We advise not to provide an opportunity for thieves, to remove all valuables, and do not leave items on display in your car.

11.3 We do not accept liability for any damages or losses.

12. NO SMOKING POLICY

12.1 Thorndale is strictly NON-SMOKING inside the property. The charge for smoking inside the property is £200 which will be deducted from the security deposit.

13. NO ELECTRIC VEHICLE/SCOOTER/BIKE CHARGING POLICY

13.1 Charging electric vehicles (EVs), electric scooters and electric bikes on the premises is strictly prohibited. 

The nearest electric charge points are listed in the FAQ section.

14. NO CANDLES & FAT FRYER POLICY

14.1 The utilisation of candles and fat fryers is strictly prohibited on this property.

15. RIGHT OF RE-ENTRY AND RIGHT TO EVICT

15.1 We are entitled to enter the Property, without providing you with prior notice in the following circumstances:

• 15.1.1 In an emergency, to include where repairs are required to be carried out due to a report made by you or damage caused by you (or where we have reasonable grounds to believe that such damage has been or may be caused). You agree not to obstruct entry to us or workmen/women.

• 15.1.2 We have reasonable grounds to believe that you are in breach of these Terms.

• 15.1.3 We have received reports from a third party advising us of conduct which is in breach of these Terms.

• 15.1.4 Please refer to clause 10.3 (Noise and/or Nuisance) and 1.7 (Booking Conditions)

16. COMPLAINTS

16.1 If you feel you have a genuine complaint in respect of the property, then this should be reported immediately to: bookings@larqueproperty.co.uk

16.2 All complaints must be made whilst you are still at the Property so that an on-the-spot investigation can be made if necessary and remedial action taken if required. In no circumstances will compensation be considered for complaints raised after the holiday has ended, when the guests have denied us the opportunity of investigating the complaint during the rental period and endeavouring to remedy matters during the rental period.

17. LIMITATION OF LIABILITY

17.1 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time of the Booking Confirmation, both we and you knew it might happen, for example, if you discussed it with us during the booking process.

17.2 You acknowledge that in booking the property, all personal belongings and vehicles including the contents of those vehicles, belonging to you and or any member of your party, is left at the Property entirely at your and their own risk. Larque Property shall accept no responsibility for any loss, or damage to you or your guest’s personal property during the rental period.

18. CHANGES TO TERMS

18.1 Larque Property may revise these Terms and Conditions at any time.

18.2 If Larque Property revise these Terms or the Terms of the Booking so as to materially affect the Booking, We will give you reasonable written notice of any changes and you can choose to cancel the rental agreement. In the event of such cancellation, we will refund any sums paid.
